This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by Arjun. Arjun Infrastructure Partners Limited is the primary data controller - Registered in England No 09431213.

Arjun may change this policy from time to time by updating this page. You should check this page from time to time to ensure you are happy with any changes.

In this Policy the term “Data Protection Legislation” means the UK General Data Protection Regulation (“UK GDPR”), the Data Protection Act 2018, the Privacy and Electronic Communications Regulations 2023, together with all other applicable legislation relating to privacy or data protection.

This website is operated by Arjun. Arjun is referred to in this Privacy Notice as “us” or “we” and you can contact us using the contact details found on our website. In this policy we describe the types of personal data which we collect and the uses which we make of it.

We are committed to protecting our clients’ privacy and complying with the Data Protection Legislation.

In connection with our business relationships with institutional investors and professional advisers, you may provide us with personal information in connection with business and investment opportunities, as well as information and reporting if your firm becomes a client of Arjun.

  3. Information you provide in relation to business matters, investment opportunities and business operations.

  4. Professional information obtained through business interactions or publicly available professional profiles.

  5. Recruitment information, including CVs, qualifications, employment history and references where you apply for a role with us.

There are also cases where personal data comes from other sources - for example in relation to details of professional experience, which, for instance, we collect from publicly accessible online profiles.

If you apply for a role with us you may provide us with personal information including your CV, contact details and other details set out in your application. We may also collect information from publicly accessible online profiles and social media platforms.

 
PURPOSE AND LEGAL GROUNDS

Your contact information may be used for the purpose of allowing us to respond to you about an enquiry you have made, and/or to further a business relationship. The legal basis for processing your contact information for these purposes is Arjun’s legitimate interest in providing you important services and/or products.

Arjun may also have to comply with other legal requirements or obligations, law enforcement, and or public safety purposes.

DISCLOSURE OF PERSONAL DATA

We disclose information about a data subject if legally obliged to do so or to comply with contractual duties.

We may disclose your Personal Data for the purposes as described in the prior section of this Privacy Policy in the following ways:

1. To affiliates and partners

With companies or ventures that are owned or controlled by Arjun, and internally within Arjun, in order to provide and improve our business operations.

2. To contracted advisors and service providers

With advisors and services providers who are contracted by Arjun to provide the services, conducting business operations or supporting transactions. This may include legal advisors, financial advisors, accountants, auditors, compliance advisers, IT service providers and other professional advisers. For example, personal data may be shared during a due diligence phase on a target transaction.

3. For Legal Compliance, Law Enforcement and Public Safety Purposes

With law enforcement, government or regulatory bodies, lawful authorities, or other authorised third parties in order to comply with laws, regulations, court orders, or other legal obligations or to assist in an investigation, to protect and defend our rights and property, or the rights or safety of third parties, to enforce an agreement with you, this Privacy Policy, or agreements with third parties, or for crime-prevention purposes.

4. For internal Know Your Customer procedures

The Know Your Customer (KYC) procedures are defined by the Arjun’s Compliance Manual , which has been developed to meet applicable legal and regulatory requirements, including those of the  Financial Conduct Authority.

5. Corporate transactions

Where necessary, personal data may be disclosed to investors, financiers, advisers or other parties involved in a proposed or completed merger, acquisition, investment, financing, restructuring or sale of assets, subject to appropriate confidentiality obligations.

 
RETENTION OF PERSONAL DATA

We retain Personal Data only for as long as necessary for the purposes for which it was collected, including to satisfy legal, regulatory, contractual, accounting and reporting obligations.

Given the long-term nature of infrastructure investments and related business activities, certain records may be retained for extended periods where this is necessary to support ongoing business operations, maintain historical transaction records, meet regulatory requirements, establish, exercise or defend legal claims, or preserve information relevant to our legitimate business interests.

We will periodically review the personal data we hold and, where information is no longer required for these purposes and there is no legal or regulatory basis for retaining it, we will take appropriate steps to securely delete, destroy or anonymise it.

INTERNATIONAL TRANSFERS

Personal data may be transferred to and processed in countries outside the United Kingdom where necessary for our business operations.

Where personal data is transferred internationally, we will ensure appropriate safeguards are implemented in accordance with UK GDPR requirements. These safeguards may include International Data Transfer Agreements (IDTAs), the UK Addendum to the EU Standard Contractual Clauses, or transfers to countries subject to adequacy regulations.

AUTOMATED DECISION MAKING

Arjun does not currently undertake solely automated decision making or profiling which produces legal or similarly significant effects on individuals.

CHILDREN

We do not knowingly collect Personal Data from children under 16. If you become aware that a child has provided us with Personal Data then please contact us. If we become aware that a child has provided us Personal Data then we will take steps to delete it and cancel any services being provided.

UK Stewardship Code Disclosure Statement

 

Arjun Infrastructure Partners Limited (“Arjun”) is required to make a public disclosure in relation to the nature of its commitment to the UK’s Financial Reporting Council’s Stewardship Code (the “Code”), in accordance with the requirements set out in COBS 2.2.3R and COBS 2.2A.5R of the Financial Conduct Authority Handbook.

 

Arjun offers investment management services to institutional investors and principally invests in privately held equity and debt in respect of infrastructure assets on behalf of its investors. While Arjun respects the general objectives of the Code, large parts of the Code are not relevant to the type of investment activities currently undertaken by Arjun. Therefore, Arjun has decided not to become a signatory to the Code. If Arjun’s investment strategy changes, such that the Code becomes more relevant to its business, Arjun will reconsider this decision.
